The agency pointed out that it had just completed nearly three years of investigation into Tesla's Autopilot system, which revealed a "critical security loophole". NHTSA also referred to Tesla's statement that "some solutions require drivers to take the initiative to choose to join and allow drivers to withdraw their participation at any time."
The agency said that although Tesla had released software updates designed to improve security, they were "not included in the recall process and did not explicitly address defects that could pose unreasonable security risks in other ways".
Tesla announced in December that it would carry out the largest recall in its history, involving 2.03 million cars in the United States, including almost all Tesla vehicles on American roads. The aim is to more effectively ensure that drivers can maintain their attention when using advanced autopilot systems.
The recall covers Model Y, X, S, 3 and Cybertruck models with autopilot systems made in the United States between 2012 and 2024.
Tesla also mentioned in December that Autopilot's software control system "may not be enough to prevent driver abuse, which may increase the risk of car accidents."
The Autopilot safety investigation, which was first launched in August 2021, found at least 13 accidents involving Tesla's vehicles, resulting in one or more deaths and several serious injuries, according to NHTSA.
Although Tesla disagreed with NHTSA's analysis, the company said it would deploy an OTA (Over-the-Air) software update to add additional controls and alarms to existing controls and alarms to further encourage drivers to adhere to their continuous driving responsibilities when enabling autopilot.
